These General Terms and Conditions of Sale ("Terms") govern online sales of goods on boutique.montandor.fr between Montandor Andorra S.L.U. ("Montandor", the "Seller"), with registered office at Avinguda Carlemany 67, AD700 Escaldes-Engordany, Andorra, and any end purchaser (the "Client"). They apply to the registered trademarks Montandor Andorra and Securit by Montandor. Placing an order on the boutique constitutes full and unreserved acceptance of these Terms. The Client acknowledges having read them before validating the order.
Professional sales to a buyer acting as a merchant or economic operator (wholesale, private label, framework contracts, supply conditions) are governed by the professional Terms published at montandor.fr/legal/terms.
1. Scope
These Terms apply to all orders placed by a Client on the online boutique, whether the Client is a consumer (as defined by the introductory article of the French Consumer Code) or a professional acting outside the scope of their main activity (e.g. small order for a café, restaurant, hotel or bar). Consumer Clients fully benefit from mandatory consumer-protection provisions (right of withdrawal, statutory warranties); the B2B professional Terms governed by the signed PDF are published on montandor.fr.
2. Order and contract formation
The order is validated when the Client confirms the cart, accepts these Terms and completes payment. A recap email is sent immediately to the address provided. The sales contract is formed upon this confirmation. The Seller reserves the right, on legitimate grounds (out of stock, suspected fraud, manifest pricing error), to cancel an order, informing the Client and refunding any sums received within fourteen (14) days.
3. Prices
Prices displayed are in euros, including all taxes (VAT inc.) for mainland France and EU countries, excluding shipping costs. Shipping costs are calculated and displayed before final order validation, based on weight, volume, destination and selected carrier. The applicable prices are those displayed at order validation. Manifest pricing errors (e.g. a derisory price resulting from a typing mistake) shall not bind the Seller.
4. Payment
Payment is made on order, by credit or debit card (Visa, Mastercard, American Express) or any other payment method offered on the boutique. Payment is processed by our PCI-DSS Level 1 certified payment service provider: no full card number transits or is stored on our servers. The transaction is secured by TLS 1.3 and, where applicable, 3-D Secure strong authentication (PSD2). In case of payment refusal, the order is automatically cancelled and no debit is made.
5. Delivery and lead times
Goods are dispatched from our main logistics warehouse in Grisolles (France, 82170). Any order validated and paid before 1:00 p.m. (Paris time) ships the same day, Monday to Friday (excluding French public holidays). Orders validated after this time or on weekends ship the next business day.
- Mainland France: delivery within 24 to 72 hours after dispatch (Chronopost or equivalent).
- European Union: 3 to 6 business days after dispatch.
- Switzerland, Andorra: 4 to 8 business days (customs formalities included).
These lead times are indicative and not binding on the Seller. Pursuant to Article L. 216-2 of the French Consumer Code, in case of substantial delay not attributable to a force-majeure event, the Client may, after a written reminder remaining ineffective within a reasonable period, request termination of the contract and full refund within fourteen (14) days. Risk of loss or damage during transport rests with the Seller, in accordance with Article L. 216-4 of the French Consumer Code.
6. 1:00 p.m. cutoff and lead times
The 1:00 p.m. Paris-time cutoff applies to orders fully paid and validated without manual intervention (payment approved, address correct, stock available). A business-day calendar (French public holidays included) determines the dispatch date. If you specify a future requested delivery date, the order falls outside the cutoff scope until that date — the calculation resumes from the date you chose.
7. Right of withdrawal (consumers)
Pursuant to Articles L. 221-18 et seq. of the French Consumer Code, the consumer Client has a period of fourteen (14) days from receipt of the order to exercise the right of withdrawal, without giving reasons and without penalty, except for return shipping costs which remain at the Client's expense.
To exercise this right, the Client notifies the decision by an unambiguous statement, by emailing info@montandor.com or using the boutique chat selecting the "Withdrawal" category. A standard form is available on request. Goods must be returned to the address provided with the return number (RMA), in their original packaging, complete, unused and as new, within a maximum of fourteen (14) days from notification. The Seller refunds the purchase price, including outbound delivery costs, within fourteen (14) days of receiving the goods or proof of their return shipment, using the same payment method as the order.
Pursuant to Article L. 221-28 of the French Consumer Code, the right of withdrawal does not apply to custom-made goods manufactured at the Client's specific request, nor to goods unsealed after delivery that cannot be returned for hygiene reasons (e.g. certain accessories in contact with food).
8. Statutory warranties
All our products fully benefit from the following statutory warranties, regardless of any commercial warranty:
- Statutory warranty of conformity (Articles L. 217-3 et seq. of the French Consumer Code): two (2) years from delivery of the goods. The Client may, at their option, require repair or replacement of the defective goods; failing that, a price reduction or contract termination. The warranty covers conformity defects existing on the day of delivery.
- Warranty for hidden defects (Articles 1641 et seq. of the French Civil Code): two (2) years from discovery of the defect. The Client may request termination of the sale or a price reduction.
To activate a warranty, contact info@montandor.com or use the boutique chat selecting "After-sales / Warranty". Provide the order reference, a description of the defect and supporting photographs. No return will be accepted without prior written consent and issue of a return number (RMA).
9. Complaints and after-sales
Any complaint, return request or after-sales matter must be sent by email to info@montandor.com or via the boutique chat selecting the relevant category. Our dedicated concierge acknowledges receipt within one (1) business day and provides a substantive answer within three (3) business days.
10. Force majeure
Pursuant to Article 1218 of the French Civil Code, the Seller may suspend performance of its obligations in case of force majeure: strikes, natural disasters, epidemics, wars, economic sanctions, embargoes, major failure of transport or telecommunications networks, or any other unforeseeable event beyond reasonable control. In case of delay exceeding thirty (30) days, the Client may terminate the order without penalty and obtain full refund of sums paid within fourteen (14) days.
11. Intellectual property
All elements of the boutique (text, photos, illustrations, logos, videos, graphics, site structure) are protected by copyright, trademark law and database law. The trademarks Montandor®, Securit® and their derivatives are registered trademarks owned by Montandor Andorra S.L.U. or its subsidiaries. Any reproduction, representation, modification, publication or adaptation, in whole or in part, by any means whatsoever, without prior written authorisation, is prohibited and constitutes infringement punishable under Articles L. 335-2 et seq. of the French Intellectual Property Code.
12. Personal data
Data collected in the context of your order is processed in compliance with the GDPR (EU 2016/679), the French Data Protection Act and the Andorran LQPD. For details on purposes, retention periods, recipients, processors, international transfers and exercise of your rights, see our privacy policy.
13. Mediation and dispute resolution
In case of dispute, the consumer Client is invited to seek an amicable solution by contacting info@montandor.com. Failing amicable resolution, and pursuant to Articles L. 612-1 et seq. of the French Consumer Code, the consumer Client may use the relevant consumer mediator free of charge. The mediator's contact details will be provided on request.
The European Commission also provides an online dispute-resolution platform at ec.europa.eu/consumers/odr.
14. Governing law and jurisdiction
These Terms are governed, for the consumer Client, by the law of the consumer's habitual country of residence within the European Union, in accordance with the Rome I Regulation (EC 593/2008). Mandatory consumer-protection provisions of French, Spanish, Italian, Portuguese, German and Swiss law remain fully applicable. Failing amicable resolution, the consumer Client may bring proceedings before the court of the consumer's place of residence or that of the Seller's registered office (Tribunal de Batlles in Andorra la Vella). For non-consumer professional Clients, the B2B Terms on montandor.fr and the jurisdiction clause they contain apply.
